Within the scope of Law No. 6698 on the Protection of Personal Data (“KVKK”), your personal data are processed by Schmid Pekintaş Güneş Enerji Sistemleri Sanayi ve Ticaret A.Ş. (“Schmid Pekintaş” or the “Company”), acting as data controller, as explained below.

This Privacy Notice is intended for persons who visit the www.schmid-pekintas.com website and contact the Company through the website.

1. Personal Data Processed

Depending on how you use the website, the following data may be processed:

  • name and surname,
  • telephone number and e-mail address,
  • requests, messages and explanations you submit through the contact form,
  • IP address, access and transaction security records,
  • information obtained through cookies and similar technologies

may be processed.

2. Purposes and Legal Grounds for Processing Personal Data

Your personal data are processed on the following legal grounds:

  • for the secure operation of the website and ensuring information security, on the basis of the Company’s legitimate interests pursuant to Article 5/2-f of the KVKK,
  • for receiving and responding to your product, service, information and quotation requests, depending on the nature of the request, where processing is directly related to the establishment or performance of a contract pursuant to Article 5/2-c of the KVKK or on the basis of the Company’s legitimate interests pursuant to Article 5/2-f,
  • for evaluating requests and complaints and conducting legal processes, pursuant to Article 5/2-e of the KVKK for the establishment, exercise or protection of a right,
  • for fulfilling obligations arising from legislation, pursuant to Articles 5/2-a and 5/2-ç of the KVKK

and are processed based on these legal grounds.

3. Method of Collecting Personal Data

Your personal data are obtained electronically through your visit to the website, your use of contact forms, your electronic communications with the Company, system and security records, and cookies and similar technologies.

4. Transfer of Personal Data

Your personal data may be transferred, only to the extent necessary and in accordance with the conditions set out in Article 8 of the KVKK, to:

  • information technology, software, server and technical support service providers,
  • authorised suppliers and business partners from which the Company receives services,
  • legal advisers,
  • authorised public institutions and organisations and judicial and administrative authorities

may be transferred.

Where personal data are transferred abroad, such transfer is carried out in accordance with Article 9 of the KVKK and the relevant legislation.

Essential cookies and other cookies depending on the user’s preference may be used on the website.

6. Your Rights under the KVKK

Under Article 11 of the KVKK, you have the right to:

  • learn whether your personal data are processed,
  • request information if they have been processed,
  • learn the purpose of processing and whether they are used in accordance with that purpose,
  • know the third parties to whom they are transferred,
  • request correction of incomplete or inaccurate data,
  • request deletion or destruction where the relevant conditions are met,
  • request notification of these operations to third parties to whom the data have been transferred,
  • object to a result arising against you as a result of analysis carried out exclusively by automated systems,
  • claim compensation for damage suffered due to unlawful processing

You may submit your requests within this scope to the Company using the methods specified in the Data Subject Application Form available on the website.

The e-mail addresses used by the Company for general communication purposes have not been designated as special application channels for requests under Article 11 of the KVKK.

Applications submitted in accordance with the applicable procedure are concluded as soon as possible and in any event no later than thirty days.
